This Privacy Statement does not apply when Personal Information is processed by third parties, for example, law enforcement authorities, credit bureaus and other financial institutions. Instead, the third parties’ processing of your Personal Information is regulated by their own privacy policies. We encourage you to read the third parties’ privacy policies and know your privacy rights before interacting with them.

By visiting and using our Website, you accept and agree to be bound by the terms of this Privacy Policy.

The term “cookies” refers to small files that a website or its service provider transfers to the User’s computer hard drive through a User’s web browser.  These cookies enable the site or service provider’s systems to recognize the User browser and capture and remember certain information.  This includes information used for convenience and site functionality (for example, account authentication, saving items in shopping carts, and retaining your site preferences).  It may also include IP addresses and browsing activity (for example, pages visited, button clicks, and actions taken on the Website).

The term “Non-Personally Identifiable Information” (“Non-PII”) is data that cannot be used, alone or in combination with other information available to us, to trace or identify a specific person.  This type of information includes aggregated statistics (anonymized data, such as website traffic numbers, survey results, or general demographic information) and technical or device data (browser types, device specifications, language preferences, and screen size).

The term “Member” refers to someone who has registered with our Website.

The term “MMS” refers to Multimedia Messaging Service, a text messaging service that allows the sending of text messages with mobile devices such as mobile phones and permits the sending of media such as pictures, video clips, audio files, and GIFs.

The term “Personally Identifiable Information” (“PII”) refers to (1) information that can be used to distinguish or trace an individual’s identity, either alone or when combined with other information that is linked or linkable to a specific individual, such as name, physical address, telephone number, e-mail address, Social Security number, date and place of birth, user name and password, IP address, and browsing history; and (2) any other information that is linked or linkable to an individual, such as educational, financial, and employment information.

2. Collection of Personal Information

Personally Identifiable Information

Christine Valmy collects Personally Identifiable Information from Users when they fill out a contact form, a consent form, an order form or otherwise provide us with PII.  For example, if you request information about our education programs through the Website, we collect your name, e-mail address, telephone number, the campus and program you are interested in, your preferred language, and how you would like us to contact you.  If you register as a Member or purchase a product, we also collect a user name and password, and your shipping address and payment information.  We do not collect Social Security numbers or financial aid information through the Website.  That information is handled separately as part of the admissions and financial aid process.  IP addresses and browsing activity are collected automatically using cookies and similar tracking technologies, as described above.

You control the amount and type of contact information you provide to us.  You can browse our Website to learn about us and the products and services we offer without completing any form.  Some information, including your IP address and your activity on the Website, is collected automatically through cookies and similar technologies whenever you visit.  You can limit that collection using the cookie preferences link on our Website or your browser settings.

Non-Personally Identifiable Information

When you visit or use the Website, we automatically collect information such as the type of browser or device operating system you use, the website you came from, the pages you view, and the time you spend on them.  We may also combine this information with data from other Users into aggregate statistics that do not identify anyone individually.

You can review and change your cookie choices at any time using the cookie preferences link on our Website.  You can also stop or restrict the placement of cookies, or remove any that may already be on your computer or device, by adjusting the preferences in your web browser.

3. Collection of Personal Information from Children

Our programs are open to students who are 18 or older, and our Website is intended for adults.  We do not knowingly collect Personal Information from anyone under 18, we do not ask for date of birth, age, or school graduation year on our Website forms, and we do not direct advertising to anyone we know to be under 18.  If we learn that we have collected Personal Information from someone under 18, we will delete it, we will not use it for any purpose, and we will not disclose it to third parties.  If you are a parent or guardian and believe your child has provided us with Personal Information, please contact us at [email protected].  We may ask you to verify your identity before we act, so that account information cannot be removed maliciously.

4. Use of Personal Information

We do not sell your Personal Information for money or other financial consideration.  We do share certain online identifiers — such as cookie identifiers, advertising identifiers, IP address, and your e-mail address in hashed (scrambled) form — with advertising platforms so that we can show you our own advertising on other websites and apps.  Some state privacy laws may define this kind of sharing as a “sale” or as “sharing” for targeted advertising.  You can opt out at any time using the “Your Privacy Choices” link on our Website, or by contacting us at [email protected].

We may use the PII you share with us for various purposes.  For example:

  • we may use your e-mail address to send you e-mails. We may use your mobile phone number to send you text messages if you have consented to receive them.  Some messages are sent by a member of our team and some are sent automatically by our systems — for example, appointment and interview reminders.  These messages may include responses to your inquiries, appointment and interview reminders, notices, order alerts, account updates, and information about our programs, products, services, and special offers.  Message frequency varies.  Standard message and data rates may apply.  Reply STOP to opt out at any time, and reply HELP for help.

  • we may use your physical address to process a delivery.

  • we may use your credit card information to facilitate payment.

  • we may use your e-mail address to send you a reminder about items you left behind in your shopping cart in our on-line store, including whether they are still available.

  • we may use information about your background to consider your application to become a student.

  • we may use username and password information to verify your authority to enter password protected areas of the Website, including the student and alumni career services portal, and customer and professional (B2B) accounts on our online store.

We also work with advertising platforms, including Google, Meta (Facebook and Instagram), and TikTok, to show you ads for our programs and products when you visit other websites and apps.  To do this, we and these platforms use cookies, device and advertising identifiers, IP address, and similar tracking technologies.  We may also provide these platforms with contact information you have given us, such as your e-mail address, in a hashed (scrambled) form, so that the platform can match you to your account with them and show you our ads.  We do this only to advertise our own programs and products.  We do not receive any new information about your identity from these platforms through this process, and our agreements with them require that this information be used only to deliver our own advertising.

We also use a service that records how visitors interact with our Website — mouse movement, clicks, scrolling, and the pages viewed — so that we can find and fix problems with the site.  These recordings are configured to hide text you enter into forms, including your name, e-mail address, and telephone number.  We do not use them to identify you, and we do not record pages that require you to log in.

We may also use Personal Information to:

  • assist us in the evaluation and training of our employees or to improve our current practices.

  • help us to better administer the Website by improving its content and personalizing your experience with it.

  • diagnose problems with servers and investigate misuse of the Website.

We collect and use all personal information in a non-discriminatory manner.

5. Disclosure of Personal Information to Third Parties

Christine Valmy does not sell your Personal Information for money or financial consideration.  We may disclose your Personal Information to certain service providers who assist us in operating the Website, conducting our business, or serving Users, so long as the information is necessary for those parties to perform their role, and those parties agree to keep this information confidential.

More specifically, we may disclose Personal Information to the following categories of service providers, in each case only as needed for them to perform services for us: our website host and developer; our e-commerce and payment platform (Shopify); payment processors; shipping carriers; our e-mail service provider; our customer relationship management (CRM) system, which our employees may use to respond to inquiries, including by individual text message where you have consented; our SMS/MMS text provider, our analytics provider; and our class and seminar booking provider.

In addition, as described above, online identifiers and hashed contact information such as your e-mail address may be shared with advertising platforms such as Google, Meta, and TikTok in order to deliver our own advertising.  Some state privacy laws treat this as a “sale” or as “sharing” for targeted advertising.  We do not share your Personal Information with any third party for that third party’s own marketing purposes, and you may opt out of this sharing at any time as described below.

We may also disclose your Personal Information when it is (a) required by law, applicable regulation or judicial process, (b) considered appropriate for the purpose of investigating unlawful activities performed on the Website, (c) necessary to protect and defend the rights or property of Christine Valmy or Website Users, or (d) required under exigent circumstances to protect the personal safety of Users or the public.

We also use Shopify to operate our online store and to process your orders and payments. When you place an order or use Shop Pay, information such as your name, e-mail address, telephone number, billing and shipping address, payment card details, and order history is processed by Shopify. If you create a Shop account, that account is provided by Shopify and is governed by Shopify’s own terms and privacy policy, available at shopify.com/legal/privacy/consumers.

6. Student Education Records

If you are or have been a student at one of our schools, the records we maintain about your enrollment, coursework, grades, financial aid, and academic progress are “education records” governed by the Family Educational Rights and Privacy Act (FERPA) and by our FERPA notice, not by this Privacy Policy.  FERPA gives you specific rights to inspect, review, and request amendment of those records, and sets its own rules about when we may disclose them.  Where this Privacy Policy and FERPA differ, FERPA governs.  This includes the student and alumni career services portal on our Website.

7. Retention of Personal Information

We keep Personal Information for as long as needed to provide our services and for our legitimate business purposes, and longer where we are required to retain it by law, including recordkeeping requirements that apply to educational institutions.

8. Security

We maintain administrative, technical, and physical safeguards that are reasonably designed to help protect your PII from loss, unauthorized access, disclosure, alteration, or destruction.  These measures include access controls, encryption of information in transit and at rest, and oversight of the service providers who handle information on our behalf.  No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Correction of Incomplete or Inaccurate PII

If for any reason you believe that the PII in our records is incomplete or inaccurate, please contact us by telephone, e-mail or in writing at the address provided below.  We will correct the information or otherwise respond within 45 days.

10. Revoking Consent to Processing and Removal of PII

If at any given point of time you would like us to stop processing your PII or to remove your PII from our system, please contact us by telephone, e-mail or in writing at the address provided below.  We will verify your identity before acting on your request.  We will remove your PII within 45 days, which we may extend once by a further 45 days where reasonably necessary, unless we are required to retain it to comply with our legal obligations, to resolve disputes, or to enforce our agreements.  This includes records we are required to keep as an educational institution participating in federal student aid programs, and student education records governed by FERPA, which we cannot delete on request.  Even if we delete some or all of your PII, we may continue to retain and use aggregate or anonymous data previously collected.

11. Opting Out; Stop Receiving E-Mails, Text Messages and Advertising

You can opt out of receiving e-mails from us by following the instructions provided at the bottom of each e-mail, by sending an unsubscribe request to us at [email protected], or by contacting us by e-mail, telephone or in writing at the address provided below.

You can opt out of receiving SMS/MMS communications at any time by replying STOP to any message.  To obtain assistance, recipients can reply HELP at any time, or contact us by telephone, e-mail or in writing at the address provided below.

You can opt out of internet advertising at any time.  You can manage your choices through Google Ad Settings, Meta Ad Preferences, TikTok’s advertising settings, and the industry opt-out tools at optout.aboutads.info and optout.networkadvertising.org; through the “Your Privacy Choices” link on our Website; or by contacting us by telephone, e-mail, or in writing at the address below.  We honor the

12. California Consumer Privacy Act and Other State Residents

As stated in our Terms and Conditions, the laws of the State of New Jersey govern the use of the Website and any disputes between us.  However, we also comply with the California Consumer Privacy Act, under which, to the extent not already covered by the provisions above, California residents also have the right to request from all businesses the following information in writing for the 12-month period preceding the request:

  • The categories of personal information collected by a business.
  • Specific pieces of personal information collected by the business.
  • The categories of sources from which the business collected personal information.
  • The purposes for which the business uses the personal information.
  • The categories of third parties with whom the business shares personal information.
  • The categories of information that the business sells or discloses to third parties.

California residents also have the right to request that PII be used only for limited purposes, such as providing you with the specific products or services you requested.

While these rights are provided to California residents under the California Consumer Privacy Act, as a matter of policy Christine Valmy makes the same request process available to all of our Users, regardless of where you live.  You may exercise any of these rights by contacting us at [email protected], by telephone, or in writing at the address below.  We will verify your identity before acting on your request.

13. Use Of Website Outside United States

14. Changes to the Policy

From time to time, we may change this Policy without advance notice.  The latest version of the Policy will be posted on the Website.  You agree to be bound by such changes.  We therefore encourage you to review the Policy each time you access the Website.
